Selection and Recruitment Privacy Policy

1. FRAMEWORK

At Tecnifar- Indústria Técnica Farmacêutica, S.A. (hereinafter Tecnifar), we respect the relationships we have with you, and we consider it extremely important to protect the privacy of all individuals whose personal information we process. Therefore, as Data Controllers, we work daily to ensure the best levels of security and to provide you with up-to-date information on how we process your data, respecting the legislation in force on the protection of personal data.

2. PURPOSE AND LAWFULNESS OF PROCESSING

The information and personal data contained in the Curriculum Vitae or other similar document, sent by any Candidate for a job, by email, through a form or other support, either spontaneously or in response to a job offer, will be processed for the purposes of Selection and Recruitment of Candidates.

This Privacy Policy applies to the personal data you provide when you apply and the subsequent information you provide in this context, as well as any information legitimately obtained, for example through third parties you have indicated, such as from former jobs or other references.

It is on the basis of your consent, Tecnifar’s legitimate interest, compliance with pre-contractual and legal obligations, as legal grounds, that we process the data covered by this policy.

3. DATA COLLECTED

This Privacy Policy applies to the personal data of Potential Candidates, Candidates and other Persons whom we contact in order to learn more about the Candidates or the contacts they have indicated as References.

Depending on the relevant circumstances and applicable local laws and requirements, we will collect all or part of the information listed below to enable us to offer you employment opportunities possibly tailored to your needs and interests. In some jurisdictions, we have limitations on the processing of some of the types of data described below. In these cases, we will not process the data in such jurisdictions. We only ask for information that we think will genuinely help us to help you, such as:

– Name;
– Age/date of birth;
– Sex;
– Photo;
– Marital status;
– Contact details;
– Education data;
– Employment history;
– Emergency contacts and details of any dependents;
– Reference data;
– Immigration status (in case you need a work permit);
– Nationality/citizenship/place of birth;
– Start date or date of availability;
– Driving license data
– Identification document details (citizen’s card, identity card, passport, residence permit, etc.);
– Bank details;
– Social security number (or equivalent in your country) and other tax information;
– Diversity information (including information related to disability and/or other information that you disclose through the voluntary provision of details);
– Details of criminal convictions, if required for the position for which you are applying;
– Details of your previous and current remuneration, pensions and benefit arrangements;
– Provisions related to childcare or caregiver functions (for example, when you authorize a deduction from your salary for childcare vouchers or when you provide this information on a voluntary basis);
– Sexual orientation (for example, when you disclose this information by providing details);
– Information about your interests and needs in relation to future employment, collected directly and inferred, for example from jobs consulted or articles read on our website or from links clicked on in emails sent by us;
– Any additional information you choose to share with us;
– Additional information that your Data Subjects choose to share with us about you;
– Additional information that our Partners may share about you or that we discover from other third party sources, such as professional job sites;
– CCTV images if you visit our premises;
– IP address (Internet Protocol);

Please note that the above list of categories of personal data we collect is not exhaustive.

4. HOW THE DATA COLLECTED IS USED

The main reason for using your personal data is to help you find job offers or jobs that may be suitable for you. The more information we have about you, your skill set and your goals, the more personalized our service can become.

Once we have obtained your data, we will use it to:

i. Recruitment activities:

Obviously, our main purpose is recruitment. We will use and process your personal data for this purpose where appropriate and in accordance with applicable law and other requirements, namely:

– Collect your data from you or from other sources/references indicated by you;

– To store your data (and update it when necessary) in our database so that we can contact you regarding recruitment;

– Providing you with our recruitment services and streamlining the recruitment process;

– Evaluate data about you in relation to the vacancies we think are suitable for you;

– Allow you to send your CV, apply for jobs or subscribe to alerts about jobs that we think may be of interest to you;

– Fulfill our obligations under any contracts entered into between us;

– Comply with our obligations arising from any contracts entered into between Tecnifar and our partners relating to your recruitment;

– Streamlining our administrative management processes;

– Carrying out candidate satisfaction surveys;

– Verify the data you have provided or to request information (such as references, qualifications and possibly any criminal convictions, insofar as this is appropriate under local law);

– Comply with our legal obligations regarding crime detection;

– Carrying out evaluation and development activities;

ii. Monitoring Equal Opportunities: We are committed to ensuring that recruitment processes are aligned with our approach to equal opportunities. Where appropriate and in accordance with local laws and requirements, we will use this information on an anonymized basis to monitor our compliance with the equal opportunities policy.

iii. In rare circumstances, we may use your personal data to help us declare, exercise or defend a right.

iv. Although at present all our recruitment activities involve human decision making during the process, we may in the future, in appropriate circumstances, use your data for Profiling, through the use of fully automated technologies such as expert systems or machine learning to carry out a selection process of Candidates from start to finish, where appropriate and in compliance with applicable legislation and other requirements. Before starting this processing, we will seek your consent to carry out some or all of these activities. If you do not consent to profiling, your application will continue to be analyzed manually in relation to opportunities you have applied for. This is likely to decrease the likelihood that we will be successful in finding you a new job. You have the right to withdraw this consent at any time through the contacts available in point 11. 5. DATA RETENTION

We will retain your Personal Data for the period strictly necessary for the purpose(s) for which it was obtained and as described in this Privacy Policy. The criteria used to determine our retention periods include:

– Deadlines described in the terms of the legislation in force;

– Period of time during which we have a relationship with you;

– Compliance with a legal obligation to which we are subject.

Tecnifar assumes that the data has been entered and transmitted by the respective owner, and that it is true and accurate/correct.

6. TRANSMISSION OF PERSONAL DATA

In pursuit of the purposes described, Tecnifar may, unless otherwise indicated by Tecnifar, have to share the information with other Group Companies and Partners for the purpose of providing a wider area of employment opportunities, as well as with Regulatory Authorities. Tecnifar may also hire a specialized external entity to process data in specific cases. Tecnifar will ensure that service providers are bound by contract and subject to a duty of confidentiality, acting in accordance with our instructions and in strict compliance with our guidelines, taking all technical and organizational measures to protect personal data against accidental or unlawful destruction, accidental loss, alteration, unauthorized disclosure or access, as well as guaranteeing a level of security appropriate to the risks inherent in the processing and the nature of the data to be protected.

7. INTERNATIONAL DATA TRANSMISSIONS

Whenever Tecnifar has to transfer personal data to a third country outside the European Union or an international organization, we will first analyze the admissibility of the transfer, adopt technical and organizational security measures and apply the standard data protection clauses adopted by the European Commission.

8. TREATMENT SAFETY MEASURES

Tecnifar implements security measures of a technical and organizational nature necessary to guarantee the security of the personal data provided to us, in order to prevent its alteration, loss, unauthorized processing and/or access, taking into account the current state of technology, the nature of the data stored and the risks presented by the processing. We have implemented specific procedures for collecting, processing and circulating information.

9. DATA SUBJECTS’ RIGHTS

In compliance with and to the extent of the provisions of the applicable legislation on the protection of personal data, the user, holder of personal data, may at any time exercise the rights of access, rectification, erasure, limitation, portability and opposition to the processing of their personal data. Candidates also have the right to withdraw their consent at any time, without compromising the lawfulness of the processing carried out on the basis of the consent previously given. To exercise their right(s), the data subject must send a written request to our Data Protection Officer using the contact details described in this Policy.

10. WHO YOU CAN COMPLAIN TO

Any complaint regarding the protection of personal data may be sent at any time to the competent supervisory authority, in the case of Portugal, the National Data Protection Commission (CNPD).

Tecnifar reserves the right, at any time, to amend, add to or revoke, in whole or in part, this Selection and Recruitment Privacy Policy, always in compliance with the General Data Protection Regulation (GDPR) and other applicable legislation. Without prejudice, Tecnifar undertakes to announce any changes by means of relevant notification.
